The terms that govern your use of this website, including what our content is and is not, when a client relationship actually begins, and how disputes are handled.

1. Acceptance of these terms

These Terms of Use (“Terms”) govern your access to and use of the website at fiscalforge.net and any pages, forms, or features on it (the “Site”), operated by FiscalForge LLC (“FiscalForge,” “we,” “us,” or “our”), a CPA-owned, Arizona-licensed accounting firm located in Scottsdale, Arizona.

By using the Site, requesting a consultation, or otherwise contacting us through it, you agree to these Terms and to our Privacy Policy & SMS Terms. If you do not agree, please do not use the Site.

2. The Site is information, not advice

Nothing on this Site is tax, accounting, legal, or financial advice. The pages here describe our services in general terms. They are not a substitute for advice about your specific facts, and you should not act or refrain from acting on anything you read here without speaking to a qualified professional about your own situation.

Tax law changes, and it applies differently depending on your filing status, entity type, state, income sources, and prior-year positions. General descriptions of deductions, deadlines, IRS procedures, or likely outcomes are illustrative only. We make no representation that any result described on this Site, or achieved for another client, will be achieved for you.

3. No client relationship until we both agree in writing

Using this Site, submitting the booking form, calling us, emailing us, or attending a consultation does not create a client relationship with FiscalForge LLC. A client relationship begins only when we and you sign a written engagement letter that identifies the specific services we will perform, and not before.

Until that engagement letter is signed, we are not responsible for your filings, deadlines, notices, or elections, and you should not rely on us to monitor or meet them. If you have an IRS or Arizona Department of Revenue deadline approaching, tell us immediately and keep protecting that deadline yourself until we have confirmed in writing that we are handling it.

Confidentiality before engagement. Information you send us before an engagement letter is signed may not be protected by accountant-client confidentiality. Please do not send sensitive details or documents until we have confirmed a secure channel and a signed engagement.

4. Booking a consultation

The booking form lets you request a 45-minute virtual consultation. A submitted request is not a confirmed appointment. We confirm times by email, and we may need to propose a different time. The calendar invitation attached to your confirmation email is a tentative hold until we confirm.

  • Consultations are scheduled Monday through Friday, 9:00 AM to 4:00 PM Arizona time, at least two days out.
  • The initial consultation is a no-obligation conversation to understand your situation and outline next steps.
  • We will be clear about any fees before you commit to anything. Fees for actual engagements are set in the engagement letter.
  • We may decline or end an engagement where we identify a conflict of interest, an independence problem, or a request we cannot ethically perform.

Please give us as much notice as you can if you need to cancel or reschedule, so we can offer the time to someone else.

5. Your responsibilities

  • Accurate information. Provide complete and accurate information when you contact us or submit a form. Our work product depends entirely on the completeness of what you give us.
  • Do not send sensitive records through this Site. This Site is not a document portal. Do not submit Social Security numbers, full account numbers, passwords, or images of tax documents through the booking form, by email, or by text. We will direct you to a secure method.
  • Your own number. Only give us a phone number you control. If you consent to text messages, you confirm you are the subscriber or customary user of that number.
  • Deadlines remain yours until we take them on. See No client relationship.

6. Communications, email, and text messages

When you contact us or request a consultation, you agree that we may respond by phone, email, or text message about that request. Text messaging is optional, is never a condition of working with us, and is governed by our SMS Terms. Reply STOP to any message to opt out.

Email and text are not secure channels. Messages can be delayed, intercepted, misdirected, or fail to arrive. Do not use them for sensitive records, and do not assume a message has been received until we acknowledge it.

7. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose, or to submit false, fraudulent, or impersonating information.
  • Submit another person's phone number, email address, or personal information without their permission.
  • Attempt to gain unauthorized access to the Site, its servers, or any connected system, or probe or test its security.
  • Introduce malware, or use automated tools to scrape, overload, or disrupt the Site or its booking form.
  • Copy, republish, or redistribute Site content for commercial purposes without our written permission.

We may suspend or block access to the Site for anyone who violates these Terms.

8. Intellectual property

The Site and its contents, including text, layout, graphics, logos, and the FiscalForge LLC name and marks, are owned by FiscalForge LLC or its licensors and are protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial reference. All other use requires our written permission.

9. Third-party links and services

The Site links to third-party resources, such as mapping services and government websites including IRS.gov and azdor.gov. We do not control those sites, do not endorse their content, and are not responsible for their accuracy, availability, or privacy practices. Review their terms and policies before relying on them or providing information.

10. Availability of the Site

We aim to keep the Site available and accurate, but we do not guarantee uninterrupted access. We may change, suspend, or discontinue any part of the Site at any time, including the booking form, without notice. If the booking form is unavailable, call us at 480-331-7805 or email contact@fiscalforge.net and we will schedule you directly.

11. Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, FiscalForge LLC disclaims all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be error-free or uninterrupted, that defects will be corrected, that the Site is free of harmful components, or that the general information on it is current, complete, or applicable to your circumstances.

This section limits warranties about the Site. It does not limit the professional standards that govern services we actually perform for you under a signed engagement letter, which are addressed in that engagement letter and by the rules of the Arizona State Board of Accountancy and applicable professional standards.

12. Limitation of liability

To the fullest extent permitted by Arizona law, FiscalForge LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost savings, or business interruption, arising out of or relating to your use of the Site, even if we have been advised of the possibility of those damages.

Cap on liability. Our total liability arising out of or relating to the Site will not exceed the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is the case, the exclusions and limits above apply only to the extent permitted, and nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify and hold harmless FiscalForge LLC and its members, employees, and contractors from any claims, damages, losses, and reasonable costs (including attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, your violation of any law, or your submission of another person’s information without their permission.

14. Governing law and where disputes are resolved

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You and FiscalForge LLC agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

Talk to us first. Before filing anything, please contact us at contact@fiscalforge.net or 480-331-7805 and give us thirty (30) days to resolve the issue directly. Most problems are faster to fix that way, and we would rather fix them.

15. Changes to these terms

We may update these Terms as our services, the Site, or our legal obligations change. The effective date at the top of this page shows when they were last revised. Your continued use of the Site after an update means you accept the revised Terms. If a change materially affects your rights, we will make that clear here before it takes effect.

16. General

  • Severability. If any provision of these Terms is held unenforceable, the rest remains in full effect and the unenforceable provision is modified to the minimum extent needed to make it enforceable.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and FiscalForge LLC regarding the Site. Where you have signed an engagement letter with us, that letter governs the services it describes and controls over these Terms to the extent of any conflict.
  • Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
